This Privacy Notice sets out how Arovis Travel & Tours Sdn Bhd (“Arovis”) will handle personal data in accordance with the Personal Data Protection Act 2010 (“PDPA”) and the laws of Malaysia.

In order to enable us to provide you with our services, we may need to and/or may be required to collect, use, disclose and store (i.e. “process”) your personal data including but not limited to your name, NRIC number, Passport number, correspondence address, email address, occupation, contact details, and such other necessary information regarding yourself and your transaction(s) with us.

1. through your relationship with us, for example information provided by you in application forms, agreements you enter into with us, when applying for our services;

We may use your personal data for one or more of the following purposes:

1. to confirm and verify your identity;
2. to assess and process your application(s) / inquiry(ies) for our services and/or under any of our scheme(s);
3. to manage and maintain your account(s) / facility(ies) with us;
4. to better manage our business and your relationship with us;
5. to better understand travel need situation;
6. to provide you with information on our products, services and programs which may be of interest to you;
7. to conduct research on new products and services for you as well as to improve our services;
8. to notify you about benefits and changes to the features of our services;
9. to respond to your enquiries and complaints and generally to resolve disputes;
10. to conduct research for analytical and/or statistical purposes;
11. to assess financial risks;
12. to transfer our rights and duties under this agreement;
13. to protect or enforce our rights to recover any debt owing to us;
14. to conduct anti-money laundering checks; for crime detection, prevention and prosecution;
15. for any other purpose that is required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities; and/or
16. to market Arovis’s products and services and sending any advertising, marketing and/or promotional material to you.

We will ask for your consent before using your personal data for a purpose other than those that are set out in this Privacy Notice and in the privacy terms in your agreement(s) with us (if any).

Disclosure Of Your Personal Data

As a part of providing you with our services and the management and/or operation of the same, we may be required or need to disclose information about you and/or your account(s)/facility(ies) with us as to the following third parties:

1. personal details;
2. companies and/or organisations that provide services to us and assist us in processing and/or otherwise fulfilling services that you have requested including but not limited to travel agency(ies), health facility(ies) provider and insurance company;
3. companies and/or organisations that assist us in providing value-added services that you have requested;
4. your advisers (including but not limited to accountants, auditors, lawyers, financial advisers or other professional advisers) where authorised by you;
5. any other person notified by you as authorised to give instructions or to use the services on your behalf;

7. any competent authority(ies) and/or regulator(s),

subject at all time to any laws, (including regulations, guidelines and/or obligations) applicable to PUNB (whether in or outside Malaysia).

We will otherwise treat your personal information as private and confidential and will not disclose your information to anyone outside of PUNB except:

1. where you have given permission;
2. where we are required or permitted to do so by law;
3. where required or authorized by any order of the court, tribunal or authority, whether governmental or quasi-governmental with jurisdiction over PUNB;
4. where we may transfer rights and obligations under this agreement;
5. where we are required to meet our obligations to any relevant authority

Exercising Your Choice In Respect Of The Disclosure And Use Of Your Personal Information For Purposes Of Marketing

We may use your personal information to provide you with information about our and third party events, training programmes and/or services, which may be of interest to or benefit you, except where otherwise requested by you.

In certain instances, we may disclose your personal information to our preferred strategic partners. However, please note that we will only disclose your personal information to our strategic partners where your prior consent has been obtained and subject at all times to any laws (including regulations, guidelines and/or obligations) applicable to Arovis. We take reasonable steps to ensure that our agreements with our strategic partners include appropriate privacy and confidentiality obligations.

If you do not wish your personal information to be utilised for the purposes of marketing or should you change your mind in relation to your previous decision, please contact us at the address detailed at the end of this Privacy Notice. Your latest written instructions to us will prevail.

It may be obligatory for you in some instances to provide certain personal information to enable us to process your application or provide you with our services. If you are unable to or decline to provide such obligatory personal information, we may not be able to process your application or provide you with the said services.

Welcome to Arovis Travel & Tours Sdn. Bhd. (“Company”, “we”, “our”, “us”)!

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at arovis.com.my (together or individually “Service”) operated by Arovis Travel & Tours Sdn. Bhd.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

We issue refunds for Contracts within 7 days of the original purchase of the Contract.

EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

17. Termination

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

If you wish to terminate your account, you may simply discontinue using Service.

All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of Malaysia, which governing law applies to agreement without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.

We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. Payment Term & Conditions

Terms & Conditions for Individual Private & Group Booking

1 Deposit RM1,000 are required to secure the booking and its cannot be cancelled and refunded.
2 Full payment should be made 45 days before the trip date.
3 The booking will only be considered confirmed after the money transfer cleared to Arovis account.
4 The total price mentioned in your document is non-commission basis and inclusive of Service & Sales Tax (SST)
5 The details each item will be detailed on separate attachment with other documents.
6 Transportation only provided as mentioned in quotation only.
7 Full Payment cannot be refunded if refund has been demanded by the client 45 days before the trip.
8 No refund is allowed if client has tested positive for Covid-19 in Malaysia, and the coverage will be processed with Policy Insurance.

Terms & Conditions Umrah Booking

1 Deposit RM1,000 are required to secure the booking and its cannot be cancelled and refunded.

9. If client ask for the cancellation for the Umrah Trip, these conditions below will be applied: 

Cancellation Notice 100 days before the trip – RM500 charged per pax
Cancellation Notice 90 days before the trip –  30% from the Full Package Price if full payment has been made or Deposit is not refundable
Cancellation Notice 60 days before the trip –  50% from the Full Package Price if full payment has been made or Deposit is not refundable
Cancellation Notice 45 days before the trip –  100% from the Full Package Price if full payment has been made or Deposit is not refundable

For Inbound: Due to various variants of concern (VOC) Covid-19, these special conditions are applied until further notice:

a) In the case of a country is banned from entering Malaysia, cancellation of payment has to be issued and ONLY 75% from full payment will be refunded.
b) Arovis Travel & Tours will hold another 25% of full payment for our management cost, bookings, and internal contract with other operators such as hotel, transport, and activities.
c) In the case the ban is lifted, and the existing Client will get 3 days free car rental and transfer in/out for the next purchase.
d) All special conditions above are APPLIED within 48 HOURS announcement before departure.

Liabilities Notice

Package Itinerary

No Itinerary suitability Guaranteed although Arovis Travel & Tours Sdn Bhd strives to provide the best service, Arovis Travel does not guarantee that all events provided are risk-free and suitable for all ages or individuals with poor health records.

Arovis Travel cannot be held responsible or bear liability if any problems related to health, pain or death arise as a result of any part of the package program you follow, whether the program is stated in the confirmation letter, advertisement or brochure of Arovis Travel or additional program while the trip is in progress.

Arovis Travel advises that you take responsibility for the risk in following the Package offered.

Possiblitiy of Itinerary Exchange

Possible Program Exchange is subject to Regulation 9 of the Fourth Schedule to the Tourism Industry Act 1992 In case of any change of itinerary, Arovis Travel will make an alternative itinerary instead and Arovis Travel is not responsible for ensuring that the alternative itinerary will equal the cost that has been paid or have a similar value as the original itinerary.

Hotel Accommodation

Accommodation classification The star rating of the hotel stated in any advertisement, brochure or correspondence from Arovis Travel is for reference only.

Hotel ratings and total stars may vary from one country to another. Arovis Travel & Tours Sdn Bhd cannot give any guarantee about the suitability of the hotel according to the hotel rating as advertised. You may not cancel your package on the grounds of a hotel rating error.

Hotel Changes

Arovis Travel & Tours Sdn Bhd reserves the right to change the accommodation hotel from the hotel specified in the brochure or package confirmation letter for reasons of no vacancy or room damage problems provided that prior notice is given to you at least 24 hours from the date of entry to the hotel .

If this happens, Arovis Travel & Tours Sdn Bhd makes no guarantees but will do its best to find an equivalent or better alternative accommodation hotel.

Arovis Travel & Tours Sdn Bhd cannot be held responsible or bear liability for any problems that arise as a result of the replacement of the accommodation hotel.

Hotel Policy

The policy regarding check-in and check-out times of the accommodation hotel is different according to the policy of the hotel. Arovis Travel & Tours Sdn Bhd cannot be held responsible or liable for any hardship you may experience as a result of the hotel’s check-in and check-out policy.

Room Types and Classifications

The type and classification of the room including the amenities (facilities) provided in the room are different according to the hotel and destination country.

Arovis Travel & Tours Sdn Bhd does not guarantee that your accommodation will be exactly as depicted in our advertisements or brochures.

Arovis Travel & Tours Sdn Bhd cannot be held responsible or bear liability for the hardship you experience as a result of the difference in the type and classification of the room you receive or due to the lack of amenities in the room.

Additional Travel Insurance Coverage

Arovis Travel & Tours Sdn Bhd only provides limited group takaful cover as stated in the brochure. As per the provisions of Regulation 12 of the Fourth Schedule of the Tourism Industry Act 1992, you are strongly advised to take out additional travel insurance to cover your trip.

You are free to choose the insurance company that suits your needs and the type of coverage that is best for you. When you choose not to take additional travel insurance, it means that you are aware of and agree to accept the liability and risk of cancellation penalties, damages and unexpected additional expenses including but not limited to medical emergency expenses during the trip.

If you have purchased additional insurance, you are advised to review the terms contained in the insurance policy to ensure that the coverage obtained is sufficient.

Arovis Travel & Tours Sdn Bhd as a third party/neutral party

Arovis Travel & Tours Sdn Bhd is only an intermediary between you and airlines, hotel accommodation, transport and/or service providers (ground suppliers).

Arovis Travel & Tours Sdn Bhd is not the owner or operator of any airline or transport company, hotel accommodation or any tour destination or any supplier associated with your package. As such, Arovis Travel & Tours Sdn Bhd cannot be held responsible for any loss, damage, delay, hardship or injury that befalls you as a result of breach of contract, intentional or unintentional omission or negligence by the airline, hotel accommodation company, transport companies and service providers (ground suppliers).

Accuracy of details or personal information when booking a package

When booking a package, all the details you give to Arovis Travel & Tours Sdh Bhd are information that will be used by the company to perfect the package you subscribe to. You are required to check all details/personal information yourself before making a deposit payment and if no corrections are made, all information given is considered true and final.

Arovis Travel & Tours Sdh Bhd cannot be held responsible for any incident or problem that arises as a result of incorrect details or personal information you provide. You are fully responsible for declaring your health status before making a deposit payment.

Arovis Travel & Tours Sdh Bhd reserves the right to reject your booking if your health level is found to endanger your own health and safety or reduce the comfort or enjoyment of other members of your tour group. If you need help due to your health, you are required to bring other family members to help you during the trip and bring your own assistive equipment such as a wheelchair and your own medicines.

Arovis Travel & Tours Sdh Bhd cannot be held responsible for taking care of you personally or providing medicines if you are sick. If your condition requires personal care, madini travel & tours sdn bhd reserves the right to charge you an additional fee to hire a third party to care for you.

Payment Terms

Arovis Travel & Tours Sdh Bhd only accepts payment in cash, bank draft or personal cheque. Arovis Travel & Tours Sdn Bhd reserves the right to hold your package booking until the deposit payment is made through your bank draft or personal cheque. 

Arovis Travel & Tours Sdn Bhd is not responsible if the package you booked has been sold out due to late payment of your bank draft or personal cheque. For package payments that are less than 7 working days before the flight date, Arovis Travel & Tours Sdn Bhd reserves the right to refuse payment by private check and if no package payment is made in cash, it may result in your package being automatically canceled and any package payment that has been made paid is forfeited according to the Fourth Schedule of the Tourism Industry Act 1992.

Airplane Ticket

Your package includes a flight ticket from klia/klia 2 to the destination only but does not include a domestic flight ticket to klia/klia 2. Although the confirmation letter and your flight schedule have been printed, the schedule is still subject to amendment by the airline.

Therefore, in the event of any change or amendment to the flight schedule, Arovis Travel & Tours Sdn Bhd cannot be held liable for any damages including but not limited to compensating for domestic ticket change fees, additional hotels or other hardships as a result of the amendment.

Arovis Travel & Tours Sdn Bhd is also not responsible for any compensation claims that arise as a result of schedule changes, delays, cancellations, missed connections, mechanical problems, bad weather, rearrangement of seats on flights, lost/delayed luggage, delayed immigration checks and /or denial of boarding by the airline.
